III. Legal basis and purpose of processing

We process the personal data we receive from our business contacts. These are collected, processed and used by us only if this is permitted by law or if you have provided consent.

For example, if you have an enquiry, ask us to submit an offer or conclude a contract with us, we will process your personal data. These can involve the following categories of personal data:

Insofar as we obtain consent for the procedures involved in the processing of personal data from the data subject, section 6(1)(a) of the European Union General Data Protection Regulation (GDPR) serves as the legal basis for the processing of personal data. Insofar as the processing of personal data is required to fulfill a legal obligation to which our company is subject, GDPR section 6(1)(c) serves as the legal basis. As a company, we are, for example, subject to statutory obligations to store data in accordance with the AO and the German Commercial Code (HGB) and are subject to monitoring, inspection, and reporting obligations.

In the event that essential or vital interests of the data subject or another natural person require the processing of personal data, the GDPR section 6(1)(d) serves as the legal basis.

If data processing is necessary to safeguard a legitimate interest of our company or that of a third party and if the interests, fundamental rights and freedoms of the data subject do not outweigh the aforementioned interest, section 6(1)(f) of GDPR serves as the legal basis for processing. In this context, we would then process your data, for example for the purpose of central customer data management within the Group or for advertising purposes.

 

IV. Data storage

We store your personal data for as long as it is necessary to fulfill our legal and contractual obligations. Your data will be deleted once storage of the data is no longer necessary for the fulfillment of contractual or statutory obligations unless its further processing is necessary for the following purposes, e.g. fulfillment of commercial and taxation storage obligations and the preservation of evidence within the framework of a legislated statute of limitations.

 

V. Data recipient


Transfer

In order to fulfill contractual and legal obligations, your personal data may be disclosed to various public agencies (e.g. taxation) or internal bodies (also within the Group), as well as external service providers (e.g. IT service providers, marketing or sales service providers).

 

Processing location

Your data will preferably be processed and used within the EU/EEA. However, processing may also be required outside the EU/EEA for certain processes. We also utilize service providers in the processing of your data. We have taken all necessary actions to ensure your data are processed in third-party countries as securely as within the European Union in order to guarantee data processing in compliance with data protection legislation.

 

VI. Your rights

Rights of the data subject

When your personal data is processed, you are the data subject within the meaning of the GDPR. In accordance with the GDPR section 12 et seq., the data controller is obliged to answer your inquiries regarding your personal data processed by MANN+HUMMEL, the right to rectification, the right to limitation of processing, the right to cancellation, the right to information, the right to data transferability, the right to object to processing, the right to withdraw your consent and the right not to be subject to a decision based exclusively on automated processing.

Right of revocation

You may object to the use of your personal data for advertising purposes at any time. In light of your objection we will no longer process your personal data unless we can prove compelling grounds for processing that would outweigh your interests, rights and freedoms, or the processing serves to assert, exercise or defend legal claims.

 

Right of appeal to the regulatory agency

Without prejudice to any other administrative or judicial remedy, you have the right of appeal to a regulatory agency, in particular in the Member State where you reside or work or that is the location of the infringement, if you believe that the processing of personal data concerning you is contrary to the GDPR.

The regulatory agency with which the complaint has been filed shall inform the complainant of the status and the results of the complaint, including the possibility of a judicial remedy under section 78 of the GDPR.

You are free to choose the regulatory agency (GDPR section 77). For example, you can address your complaint to the regulatory agency responsible for MANN+HUMMEL in the state of Baden-Wuerttemberg in Germany.

VIII. MANN FILTER website


Usage data

When you visit our MANN FILTER website, general data about that process is automatically logged and stored in a log file. This serves system-related purposes only. The stored usage data is not stored together with other personal data. More precisely, the following data record is stored for each retrieval:

 

  • Anonymized IP addresses
  • Date and time of retrieval
  • Name of the retrieved file
  • Message as to whether the retrieval was successful (status code)
  • Transferred data volume
  • Website on which the retrieval request took place

The above data will not be forwarded to third parties or evaluated in any other way, unless there is a statutory obligation to do so.

Contact

Newsletter

There is the possibility of subscribing to free newsletters that provide information on updates and offers regarding our products. For this purpose, the e-mail you enter will be sent to us. Your personal data will be processed during registration for the purpose of sending you a newsletter.

A confirmation e-mail will be sent to you upon registering for the newsletter to verify your person. We store your IP address and the date of registration. Storing this information serves solely as proof in the event of a third party misusing an e-mail address and registering for the newsletter without the knowledge of the authorized party.

You can revoke your consent to storage of your personal data at any time. Revoking your consent can take place via a link in the newsletter itself. After revocation of consent, your data will be deleted immediately. You will no longer receive newsletters. Please note that the revocation only applies for the future.

In order to better understand how our newsletter is used, we evaluate your user behavior when sending the newsletter. However, this is done exclusively in pseudonymized form.
