MANN+HUMMEL is committed to data protection and provides this data protection statement to explain which of your personal data is processed by us. The protection of your privacy is a top priority for us. Which is why it goes without saying that we comply with the strict legal provisions on data protection. Data protection begins with transparency. It therefore matters to us that you are aware at all times of when we store which of your personal data, what purpose we use it for, but also how you can restrict or block that use. Our data protection provisions are designed in such a way that they comply with current data protection laws.

III. Legal basis and purpose of processing
We process the personal data we receive from our business contacts. These are collected, processed and used by us only if this is permitted by law or if you have provided consent.
For example, if you have an enquiry, ask us to submit an offer or conclude a contract with us, we will process your personal data. These can involve the following categories of personal data:
- Contact details (title, name, address)
- Communication data (telephone, e-mail address, language/region)
If you provide us with your contact details at a trade fair, e.g. by giving us your business card, taking part in a competition or registering for our newsletter, we record that data in our CRM system. We use your data to contact you as requested, to establish a business relationship and to send you information material.
We also process your personal data to fulfill legal obligations, to protect a legitimate interest or on the basis of a consent provided by you:
Insofar as we obtain consent for the procedures involved in the processing of personal data from the data subject, section 6(1)(a) of the European Union General Data Protection Regulation (GDPR) serves as the legal basis for the processing of personal data. In the following instances, for example, we process your personal data based on a particular consent provided by you:
- Sending an e-Newsletter to you by e-mail
- Newsletter tracking
- Market research (e.g. customer satisfaction surveys)
- Marketing and advertising
- Preparation of customer profiles
Insofar as personal data is required for the performance of a contract to which the data subject is a party, section 6(1)(b) of the GDPR serves as the legal basis. This also applies to processing operations that are necessary to execute pre-contract measures. Within a contractual relationship, your data will be processed by us in particular to carry out the following activities:
- Contacting you in regard to the contract
- Contract management
- Ongoing customer care
- Service center
- Processing warranty claims
- Claims management
- Contract termination management
Insofar as the processing of personal data is required to fulfill a legal obligation to which our company is subject, GDPR section 6(1)(c) serves as the legal basis. As a company, we are, for example, subject to statutory obligations to store data in accordance with the AO and the German Commercial Code (HGB) and are subject to monitoring, inspection, and reporting obligations.
In the event that essential or vital interests of the data subject or another natural person require the processing of personal data, the GDPR section 6(1)(d) serves as the legal basis.
If data processing is necessary to safeguard a legitimate interest of our company or that of a third party and if the interests, fundamental rights and freedoms of the data subject do not outweigh the aforementioned interest, section 6(1)(f) of GDPR serves as the legal basis for processing. In this context, we would then process your data, for example for the purpose of central customer data management within the Group or for advertising purposes.
IV. Data storage
We store your personal data for as long as it is necessary to fulfill our legal and contractual obligations. Your data will be deleted once storage of the data is no longer necessary for the fulfillment of contractual or statutory obligations unless its further processing is necessary for the following purposes, e.g. fulfillment of commercial and taxation storage obligations and the preservation of evidence within the framework of a legislated statute of limitations.
V. Data recipient
In order to fulfill contractual and legal obligations, your personal data may be disclosed to various public agencies (e.g. taxation) or internal bodies (also within the Group), as well as external service providers (e.g. IT service providers, marketing or sales service providers).
Your data will preferably be processed and used within the EU/EEA. However, processing may also be required outside the EU/EEA for certain processes. We also utilize service providers in the processing of your data. We have taken all necessary actions to ensure your data are processed in third-party countries as securely as within the European Union in order to guarantee data processing in compliance with data protection legislation.
VI. Your rights
Rights of the data subject
When your personal data is processed, you are the data subject within the meaning of the GDPR. To exercise your rights as the data subject, you may contact the data protection officer using the contact details provided or contact customer service: email@example.com We will process your inquiries immediately and in accordance with legislated requirements and inform you of the actions we have taken.
Right of revocation
You may object to the use of your personal data for advertising purposes at any time. In light of your objection we will no longer process your personal data unless we can prove compelling grounds for processing that would outweigh your interests, rights and freedoms, or the processing serves to assert, exercise or defend legal claims.
Right of appeal to the regulatory agency
Without prejudice to any other administrative or judicial remedy, you have the right of appeal to a regulatory agency, in particular in the Member State where you reside or work or that is the location of the infringement, if you believe that the processing of personal data concerning you is contrary to the GDPR.
The regulatory agency with which the complaint has been filed shall inform the complainant of the status and the results of the complaint, including the possibility of a judicial remedy under section 78 of the GDPR.
You are free to choose the regulatory agency (GDPR section 77). For example, you can address your complaint to the regulatory agency responsible for MANN+HUMMEL in the state of Baden-Wuerttemberg in Germany.
